With the following privacy policy statement, we inform you in particular about the type, scope, purpose, duration and legal basis of the processing of personal data, insofar as we decide either alone or jointly with others on the purposes and means of the processing. II. Rights of the users and data subjects

With regard to the data processing described in more detail below, users and data subjects have the right to

  • confirmation as to whether data concerning them are being processed, information on the data processed, further information on the data processing and copies of the data (cf. also Art. 15 GDPR);
  • correction or completion of inaccurate or incomplete data (cf. also Art. 16 GDPR);
  • immediate erasure of the data concerning them (cf. also Art. 17 GDPR), or, alternatively, insofar as further processing is necessary pursuant to Art. 17 (3) GDPR, restriction of processing in accordance with Art. 18 GDPR;
  • to receive the data concerning them and provided by them and to transfer this data to other providers/controllers (cf. also Art. 20 GDPR);
  • to lodge a complaint with the supervisory authority if they believe that the data concerning them is being processed by the provider in breach of data protection law (cf. also Art. 77 GDPR).

In addition, the provider is obliged to inform all recipients to whom data has been disclosed by the provider of any correction or deletion of data or restriction of processing that takes place on the basis of Articles 16, 17 (1) and 18 of the GDPR. However, this obligation shall not apply if such notification is impossible or involves a disproportionate effort. Notwithstanding this, the user has the right to information about these recipients

Users and data subjects also have the right to object to the future processing of data relating to them in accordance with Art. 21 GDPR, insofar as the data is processed by the provider in accordance with Art. 6 para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permitted.
 

III. Information on data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose of the storage no longer applies, the deletion of the data does not conflict with any statutory retention obligations and no other information is provided below on individual processing procedures.
 

Server data

For technical reasons, in particular to ensure a secure and stable internet presence, data is transmitted by your internet browser to us or to our web space provider. These so-called server log files are used to collect, among other things, the type and version of your internet browser, the operating system, the website from which you accessed our website (referrer URL), the website(s) of our website that you visit, the date and time of the respective access as well as the IP address of the internet connection from which our website is used.

The data collected in this way is temporarily stored, but not together with other data about you.

This storage takes place on the legal basis of Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality and security of our website.

The data is deleted again after seven days at the latest, unless further storage is required for evidence purposes. Otherwise, the data is exempt from deletion in whole or in part until the final clarification of an incident.

Registration for FSF trainings

If you register for our trainings, the data you requested for this purpose (surname, first name, email address, institution) will be transmitted to us. The co-organiser oft he trainings is the Freiwillige Selbstkontrolle Multimedia-Diensteanbieter e.V. (Voluntary Self-Regulation of Multimedia Providers), to whom we forward your registration data in ordert o ensure that the event is carried out properly. At the same time, we store the UP address of the internet connection from which you access our website as well as the date and time of your registration. In the course of the further registration process, we will ask for your consent to send you the dial-in data for the respective training, describe the content in concrete terms and refer to this data protection declaration. We will use the data collected exclusively for sending the dial-in link and the programme fort he respective training – in particular, it will not be passed on to third parties.

The legal basis for this ist art. 6 para. 1 lit. a) GDPR.

In accordance with art. 7 para. 3 GDPR, you can revoke your consent to participate in the training at any time with future effect. To do so, you only need to inform us of your revocation.
 

Contact requests/contact possibility

If you contact us via the contact form or e-mail, the data you provide will be used to process your enquiry. The provision of the data is necessary for the processing and answering of your enquiry - without their provision we cannot answer your enquiry or at best only to a limited extent.

The legal basis for this processing is Art. 6 para. 1 lit. b) GDPR.

Your data will be deleted if your enquiry has been finally answered and the deletion does not conflict with any legal obligations to retain data.

The legal basis for the processing of personal data that takes place as a result and is reproduced below is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the analysis, communication and advertising of our services.

The legal basis may also be the user's consent pursuant to Art. 6 para. 1 a) GDPR vis-à-vis the platform operator. The user can revoke this consent for the future at any time by notifying the platform operator in accordance with Art. 7 para. 3 GDPR.

When our online presence is accessed on the Facebook platform, user data (e.g. personal information, IP address, etc.) is processed by meta Ireland Ltd. as the operator of the platform in the EU.

This user data is used for statistical information about the use of our association presence on Facebook. meta Ireland Ltd. uses this data for market research and advertising purposes and to create profiles of the users. On the basis of these profiles, meta Ireland Ltd. is able, for example, to advertise users within and outside of meta according to their interests. If the user is logged into his or her Facebook account at the time of the call, meta Ireland Ltd. can also link the data to the respective user account.

If the user contacts meta Ireland Ltd. via Facebook, the personal data entered by the user on this occasion will be used to process the request. The user's data will be deleted by us as soon as the user's enquiry has been conclusively answered and there are no statutory retention obligations to the contrary.

Cookies may also be used by meta Ireland Ltd. to process the data.

If the user does not agree to this processing, it is possible to prevent the installation of cookies by setting the browser accordingly. Cookies that have already been stored can also be deleted at any time. The settings for this depend on the respective browser. Linking social media via graphic or text link

We also promote presences on the social networks listed below on our website. The integration takes place via a linked graphic of the respective network. The use of this linked graphic prevents a connection from being automatically established to the respective server of the social network when a website with a social media advertisement is called up in order to display a graphic of the respective network itself. Only by clicking on the corresponding graphic will the user be redirected to the service of the respective social network.

After the user has been forwarded, information about the user is collected by the respective network. It cannot be ruled out that the data collected in this way is processed in the USA.

This is initially data such as IP address, date, time and page visited. If the user is logged into his/her user account of the respective network during this time, the network operator may be able to assign the collected information of the specific visit to the personal account of the user. If the user interacts via a "Share" button of the respective network, this information can be stored in the user's personal user account and may be published. We use YouTube in connection with the "extended data protection mode" function in order to be able to show you videos. The legal basis is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest lies in improving the quality of our website. According to YouTube, the "enhanced data protection mode" function means that the data described in more detail below is only transmitted to the YouTube server when you actually start a video.

Without this "extended data protection", a connection to the YouTube server in the USA is established as soon as you call up one of our Internet pages on which a YouTube video is embedded.

This connection is necessary in order to be able to display the respective video on our website via your internet browser. In the course of this, YouTube will at least record and process your IP address, the date and time as well as the website you visited. In addition, a connection to Google's "DoubleClick" advertising network is established.

Matomo

This website uses Matomo, an open source, self-hosted software to collect anonymous usage data for this website.

The data on visitor behaviour is collected to identify any problems such as pages not found, search engine problems or unpopular pages. Once the data (number of visitors who see error pages or only one page, etc.) is processed, Matomo generates reports for the website owners to react to. (layout changes, new content, etc.)

When you use this website, the call is recorded by the host of the website (Hetzner Online GmbH). This log contains your IP address, which indirectly identifies you through your internet service provider. The recording of this data is mandatory by law and necessary for security. There is no possibility to opt-out, but the data will never be used for other purposes.

Data processing is based on the principle of legitimate interest.

Processing data helps us to find out what works on our site and what does not. For example, it helps us find out if the content is well received or how we can improve the structure of the website. OpenStreetMap

In our website we use OpenStreetMap to display our location as well as to create directions. This is a service of FOSSGIS e.V., which acts as the contact for the OpenStreetMap project in Germany.

The legal basis is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in optimizing the functionality of our website.

Maps of the "OpenStreetMap" service are integrated on our website (https://www.openstreetmap.org ), which are offered on the basis of the Open Data Commons Open Database License (ODbL) by the OpenStreetMap Foundation (OSMF). OSMF Privacy Policy.

To our knowledge, the data of users is used by OpenStreetMap exclusively for the purpose of displaying the map functions and temporarily storing the selected settings. This data may include, in particular, IP addresses and location data of the users, which, however, are not collected without their consent (usually executed in the context of the settings of their mobile devices).
 

Zoom

We use the tool "Zoom" to conduct telephone conferences, online meetings, video conferences and/or online trainings (hereinafter: "Online Meetings"). "Zoom" is a service provided by Zoom Video Communications, Inc. which is based in the USA.

The data controller for data processing directly related to the conduct of "Online Meetings" is Freiwillige Selbstkontrolle Fernsehen e.V.

Note: Insofar as you call up the website of "Zoom", the provider of "Zoom" is responsible for data processing. However, calling up the website is only necessary for using "Zoom" in order to download the software for using "Zoom".

 You can also use "Zoom" if you enter the respective meeting ID and, if applicable, further access data for the meeting directly in the "Zoom" app.

If you do not want to or cannot use the "Zoom" app, the basic functions can also be used via a browser version, which you can also find on the "Zoom" website.

Various types of data are processed when using "Zoom". The scope of the data also depends on the data you provide before or during participation in an "online meeting".

 The following personal data are subject to processing:

  • User details: first name, last name, telephone (optional), e-mail address, password (if "single sign-on" is not used), profile picture (optional),
  • Department (optional)
  • Meeting metadata: Topic, description (optional), participant IP addresses, device/hardware information.
  • If recorded (optional): MP4 file of all video, audio and presentation recordings, M4A file of all audio recordings, text file of online meeting chat.
  • For dial-in with the telephone: information on the incoming and outgoing call number, country name, start and end time. If necessary, further connection data such as the IP address of the device can be stored.

- Text, audio and video data: You may have the opportunity to use the chat, question or survey functions in an "online meeting". In this respect, the text entries you make are processed in order to display them in the "online meeting" and, if necessary, to record them. In order to enable the display of video and the playback of audio, the data from the microphone of your terminal device and from any video camera of the terminal device are processed accordingly during the meeting. You can switch off or mute the camera or microphone yourself at any time via the "Zoom" applications.

To participate in an "online meeting" or to enter the "meeting room", you must at least provide information about your name.

We use "Zoom" to conduct "online meetings". If we want to record "online meetings", we will inform you transparently in advance and - if necessary - ask for your consent. The fact of the recording will also be displayed to you in the "Zoom" app.

If it is necessary for the purposes of recording the results of an "online meeting", we will record the chat content. However, this will not usually be the case.

In the case of webinars, we may also process questions asked by webinar participants for the purposes of recording and following up webinars.

If you are registered as a user with "Zoom", then reports on "online meetings" (meeting metadata, telephone dial-in data, questions and answers in webinars, survey function in webinars) may be stored by "Zoom" for up to one month.

Automated decision-making within the meaning of Art. 22 GDPR is not used.

Insofar as personal data of employees of Freiwillige Selbstkontrolle Fernsehen e.V. are processed, Section 26 BDSG is the legal basis for data processing. If, in connection with the use of "Zoom", personal data is not required for the establishment, implementation or termination of the employment relationship, but is nevertheless an elementary component of the use of "Zoom", the legal basis for data processing is Art. 6 para. 1 lit. f) GDPR. In these cases, our interest lies in the effective implementation of "online meetings".

Otherwise, the legal basis for data processing when conducting "online meetings" is Art. 6 para. 1 lit. b) GDPR, insofar as the meetings are conducted within the framework of contractual relationships.

If there is no contractual relationship, the legal basis is Art. 6 para. 1 lit. f) GDPR. Here, too, our interest is in the effective conduct of "online meetings".

 "Zoom" is a service provided by a provider from the USA. A processing of personal data therefore also takes place in a third country. We have concluded an order processing agreement with the provider of "Zoom" that complies with the requirements of Art. 28 GDPR.

An appropriate level of data protection is guaranteed on the one hand by the conclusion of the so-called EU standard contractual clauses. As additional protective measures, we have also configured Zoom in such a way that only data centres in the EU, the EEA or secure third countries such as Canada or Japan are used to conduct "online meetings".
